BY-LAWS

Article I. Name

The name of this organization shall be the IRONMARSHALS Motorcycle Club. (herein called the “Club”).

Article II. Purpose

A: The Club is an independent organization not affiliated or sponsored by any motorcycle manufacturer or police agency. 

B: The Club was instituted to offer motorcycling benefits and services to active and retired members of the club.

C: The goal of the Club is to generate an increased level of enthusiasm for riding motorcycles.

D: Club events are intended to promote safe activities, And to generate good clean family fun.

Article III. Membership

Eligibility:

In order to seek membership into the club, you need to meet all of the following conditions to qualify for membership.

1)   You must own and ride a motorcycle of 450 cc or larger and be able to travel at highway speeds. And Attend at least 3 Rides Per Month Manditory.

2)   Any make of motorcycle is allowed for membership into the club.

3)   You must be properly licensed to ride and operate a motorcycle.

4)   You must be at least 18 years of age.

5)   At least 70% of the ballots returned must be of the affirmative nature.

6)   A prospective member must follow all rules of prospecting.

7)   Any ex-member wishing to rejoin the club may be accepted by a vote of the Executive Board, as a regular member. Providing all other qualifications are met, and upon payment of all fee’s/past due's owed. This Only Applies if Ex Member is within the 6 Month Period of re-Joining status. Otherwise Ex Member will have to  start at prospecting unless voted upon by full current membership.

8)   You must give up all IRONMARSHALS colors if you are dismissed or resign from the club.

9) In the event that you give up membership of the club you lose all membership classifications, Dues Paid, Initiation Fee Paid, Club privileges and must surrender IRONMARSHALS M.C. colors at this time.

The Officers of the club will be as follows:

Article V. General Provisions

 

A)  Dues:  Dues will be assessed by each chapter.

B)  Colors:  All patches will be the same on the back, nothing will show on the back except the IRONMARSHALS M.C. patch. There is only one OFFICIAL patch design for the club, and it will not be changed or altered by any member or chapter. All colors remain the property of the IRONMARSHALS M.C. and must be returned to the club if a member is dropped from the rolls or leaves the club of his own accord.

C)  Wearing of Colors:  All patch holders will wear their colors on all club runs or functions.

D)  Each Chapter will have an official chapter meeting at least once a month at a predetermined place and time, unless meetings are suspended by the chapter executive board.

E)   Each Chapter is free to run events and other activities without the approval of the National Chapter. As long as such events and activities meet Club rules of conduct.

F)   Only patch holders and prospects are allowed to vote on club business. Input from family of club members is appreciated.

G)  All members must own and ride a motorcycle.

H)  Members cannot belong to other Motorcycle Clubs. With the exception of proactive Organizations such as but not limited to Abate, Hog, AMA or Gold Wing Association.

I)    The use of safety helmets while on runs is strictly up to the member, but must be in accordance with Local or State Law.

J)   All members must be licensed to operate a motorcycle.

K)  The National Chapter will be known as IRONMARSHALS M.C.   N.E. OHIO CHAPTER 1 based in Cleveland, Ohio.

Article VI. Parliamentary Authority

 

The Executive Board of the National Chapter of the IRONMARSHALS M.C. shall by a majority vote decide all matters that are not covered in these by-laws. The Board may use any and all reference material at their disposal to make such decisions.

Article VII. Amendments

 

A)  The by-laws of the club will be reviewed in September of every odd ending year. This review will be conducted by the National Executive Board, and will be regulated by the IRONMARSHALS M.C. supplement titled By-laws review.

 

B)   These by-laws can only be brought up for amendment by a two thirds vote of the members of the National Chapter.

 

C)  In order to amend the by-laws after they are brought up for amendment. A two thirds affirmative vote  must be reached by the Local Chapter Presidents.

 

D)  A telephonic meeting of the National President of the IRONMARSHALS M.C. and local Chapter Presidents will constitute a valid voting meeting for by-law amendment.

CLUB OFFICERS

 

TERMS OF OFFICE:

All terms for Officers of the club will be four (4) years.

OFFICERS:

The officers of the club will be as follows:

President

Vice President

Treasurer

Secretary

Sergeant at Arms / Road Captain

 

OFFICERS DUTIES:

President:

* Shall preside at all meetings of the club.

* Shall be the cosigner with the Treasurer of all Club checks.

 * Shall have the power to call special meetings of the club and cause the Secretary to make a record of such meetings.

Vice President:

At the request of the President or in the event of the Presidents absence:

* Shall perform the duties and possess and exercise the powers of the President.

 * Shall assume the office of the President in the event the office of the President is vacated for any reason, And shall serve the remaining time of that term.

 

Treasurer:

* Shall have custody of all funds and property of  the club.

* Shall receive all funds, make all deposits and maintain accurate and neat financial records for the club.

* Shall cosign with the President on all club checks.

* Shall make a full and accurate report and produce an active bank statement at all monthly club meetings.

* Shall perform all duties associated with the office Of Treasurer.

 

Secretary:

 * Shall have charge of all club books, documents and papers.

* Shall have custody of the corporate seal of the Club.

 * Shall keep a record of the names and addresses of  all members and prospects of the club.

 * Shall keep membership record in alphabetical order.

* Shall keep the minutes of all club meetings.

* Shall at the request of the President give adequate notice of all special and general Membership meetings.

 

Sergeant at Arms / Road Captain:

 * Shall enforce all rules at all club rides.

* Shall route, lead, and have an alternate route planned for all club rides.

 

ELECTIONS:

Elections shall be held every four (4) years in September starting in the year of 1999. The election will be by secret mail in ballot. Nominations will be in August of the election year.

 

QUALIFICATIONS:

To qualify for any of the above offices a club member must have been a full patch member for at least one (1) year.

RULES OF PROSPECTING

 

 a) PROSPECT PERIOD: The prospect period will consist of one year. (From date of Application) The first 30 days a prospect will receive no patches. After 30 days prospect will receive top rocker and M.C Prospect will receive bottom rocker and center patch when voted into club.

b) PROSPECT VOTE: The vote for a prospect to enter the club as a full patch member Will be by mail, for a vote by the full membership. prospect will need 70% of the ballots returned to be of the Affirmative nature. The ballots will be held for a period of 6 months.

c) PROSPECT REQUIREMENTS: Prospect must be at least 18 years of age. Prospect must have a valid m.c. Endorsement. Prospect must have a motorcycle of 450 cc or larger and Be able to travel at highway speeds.

d) PROSPECT FEES: Prospect initiation fee of $100.00, Non-refundable to prospect. Non-refundable monthly dues of $5 will be paid by the prospect. Initiation fee of 50% up front will be paid by the prospect after the First 30 days, and the rest can be paid in 2 monthly installments. (Or The whole amount can be paid in full) $5.00 monthly dues to be paid at time of application. Can Also Pay Dues In Full In The Amount Of $50 Per Calendar Year

e) PROSPECT OBLIGATIONS: A prospect must make 3 rides a month during the riding Season (Absence may be permitted with prior notice and Good reason.) A prospect must attend all meetings of the club. (Absence May be permitted with prior notice and good reason.). A prospect will be responsible to perform security duties During club events. Prospects will be required to perform miscellaneous duties As requested by the club. (No prospect will be required to do  anything illegal, immoral, or degrading) Prospects will be required to abide by the club’s rules of Conduct.

f) COLORS: All club colors are the property of the IRONMARSHALS M.C. All colors must be surrendered upon request of the IRONMARSHALS M.C.

CLUB  RULES OF CONDUCT

 

RULES OF CONDUCT:

a) Colors shall not be worn into any establishment with the intention of starting trouble.

b) Fighting is forbidden for any club member while wearing club colors except in the case of self-defense.

 c) Club colors shall always be handled in a respectful manner.

d) Conduct yourself with dignity. Public behavior directly reflects upon the club.

e) Members are expected to stop and offer roadside assistance to any fellow motorcyclist in need.
